Choose a 3-Year or 5-Year Protection Plan for extended service coverage against covered mechanical and electrical failures during normal use. The Plan is optional, has no deductible, and is administered by Cubie by Brandstand.

Not covered: accidental damage, drops, spills, loss, theft, misuse, cosmetic-only damage, unauthorized modification or repair, improper installation or electrical supply, transit/relocation damage, or external events such as fire, flood, weather or natural disaster.

Standard Warranty

All Cubie by Brandstand products include a standard one-year warranty against manufacturing defects in materials and workmanship under normal use, beginning on the date of purchase.

The Cubie Protection Plan does not replace the standard warranty. It provides covered service through the end of the selected 3-Year or 5-Year Protection Plan term.

Full Terms & Conditions

1. Agreement and Parties

These Cubie Protection Plan Terms and Conditions (“Terms”) govern the optional Cubie Protection Plan (“Plan”) purchased in connection with eligible products sold by TXS Industrial Design, Inc. d/b/a Cubie by Brandstand (“Cubie by Brandstand,” “we,” “us,” or “our”). “You” and “your” mean the purchaser of the Plan and, if transfer is permitted under Section 12, a permitted transferee.

The Plan is a service contract purchased separately from the Covered Products. It is not the standard warranty included in the purchase price of a Cubie by Brandstand product and is not intended to be described as a “full” or “limited” written warranty under federal warranty law.

2. Plan Purchase and Proof of Coverage

The Plan must be purchased in connection with the Covered Products and must appear on the applicable Cubie by Brandstand order confirmation or invoice. Your Cubie by Brandstand order confirmation or invoice showing the Plan is your proof of coverage. No separate registration is required unless Cubie by Brandstand specifically requests it.

The price paid for the Plan is the “Plan Price.”

3. Covered Products and Coverage Amount

“Covered Products” means the products purchased on the same Cubie by Brandstand order to which the Plan applies. Unless the order or Plan description states otherwise, the Plan applies to all products on that order.

The “Coverage Amount” is the original purchase price of the Covered Products on the applicable order, excluding taxes, shipping or delivery charges and the Plan Price.

4. Coverage Term

The Coverage Term begins on the original purchase date of the Covered Products.

  • 3-Year Protection Plan: coverage continues through the third anniversary of the original purchase date.
  • 5-Year Protection Plan: coverage continues through the fifth anniversary of the original purchase date.

The Coverage Term includes any period during which Cubie by Brandstand's standard warranty applies. The Plan does not add three or five additional years after the standard warranty expires.

5. What Is Covered

During the Coverage Term, the Plan covers mechanical or electrical failure of a Covered Product occurring during normal commercial use, including failure caused by defects in materials or workmanship.

Depending on the Covered Product, covered failures may include failure of charging, power, USB/USB-C, wireless charging, display, clock, controls, internal electrical components, or other functional components incorporated into the product.

The Plan is available exclusively for products purchased for business or commercial use and is not available for products purchased primarily for personal, family, or household use. Coverage includes eligible commercial installations, including hotels, hospitality properties, offices, healthcare facilities, educational facilities, and other business environments, provided the Covered Product is used for its intended purpose and in accordance with Cubie by Brandstand instructions.

By purchasing the Plan, the purchaser represents and certifies that the Covered Products are being purchased for business or commercial use and not primarily for personal, family, or household use.

6. How Cubie by Brandstand Will Provide Service

For an approved claim, Cubie by Brandstand may, at its option:

  • Troubleshoot or repair the Covered Product;
  • Replace the Covered Product with the same model;
  • Replace it with a product of comparable functionality and value if the same model is unavailable; or
  • Provide another remedy up to the original purchase price of the affected Covered Product.

Replacement products may differ in model, design, color, features or appearance. Cubie by Brandstand may require return of the affected Covered Product before providing a replacement or other remedy.

7. Coverage Limit

Cubie by Brandstand's aggregate obligation for all claims under the Plan will not exceed the Coverage Amount.

Claims may be made for multiple Covered Products during the Coverage Term until the aggregate value of repairs, replacements and other remedies provided under the Plan reaches the Coverage Amount. Once that amount has been reached, Cubie by Brandstand's obligations under the Plan are fulfilled.

Coverage follows the applicable order and Coverage Amount; the Plan does not require individual units on a multi-unit order to be separately designated by serial number unless Cubie by Brandstand specifically requires serial-number identification for a particular product.

8. What Is Not Covered

The Plan does not cover:

  • Accidental or physical damage, including drops, impacts, spills or liquid damage;
  • Loss, theft, disappearance or products no longer in your possession;
  • Intentional damage, misuse, abuse, negligence or neglect;
  • Normal wear and tear that does not impair product functionality;
  • Cosmetic damage that does not impair normal operation, including scratches, dents, discoloration or finish changes;
  • Damage or failure caused by improper installation, assembly, hookup, modification, alteration or unauthorized repair;
  • Use contrary to Cubie by Brandstand's instructions or the intended use of the product;
  • Damage caused by improper, inadequate or abnormal electrical or power supply, except to the extent Cubie by Brandstand expressly states otherwise;
  • Damage occurring during shipping, delivery, transportation, relocation, removal, reinstallation, storage, packing or unpacking;
  • Fire, flood, weather, lightning, natural disaster, vandalism, infestation, corrosion or other external causes;
  • Consumable or user-replaceable components, unless expressly stated as covered;
  • A product sold “as-is,” as a demonstration unit, or identified as not eligible for the Plan;
  • Pre-existing conditions or failures that existed before the Plan was purchased;
  • Any failure, damage, repair or loss reimbursed or covered by another warranty, service contract or insurance policy;
  • Consequential or collateral damage to other property;
  • Bodily injury, property damage, loss of use, fire damage, smoke damage
  • Bodily injury, property damage, loss of use, fire damage, smoke damage, water damage, or any other loss or damage allegedly caused by a Covered Product or by the failure of a Covered Product; or
  • Any costs, damages or liabilities other than repair, replacement or another expressly authorized remedy for the Covered Product itself.

9. How to Request Service

To request service, contact Cubie by Brandstand Customer Service at sales@brandstand.com. Documentation of the claimed failure is required. You must provide:

  • The original Cubie by Brandstand order or invoice number;
  • Identification of the affected Covered Product;
  • A description of the problem;
  • Clear photo and/or video documentation reasonably demonstrating the claimed failure; and
  • Any additional troubleshooting information or other reasonable documentation requested by Cubie by Brandstand.

Cubie by Brandstand may attempt troubleshooting before authorizing repair, replacement or another remedy. Do not incur repair or replacement costs on Cubie by Brandstand's behalf without prior written authorization unless applicable law provides otherwise.

10. Customer Responsibilities

You must use and maintain Covered Products in accordance with Cubie by Brandstand's instructions and take reasonable steps to prevent additional damage after a failure occurs.

You must provide reasonable information needed to evaluate a claim and, when requested, make the affected Covered Product available for inspection or return.

11. No Deductible; Shipping

There is no deductible for an approved claim under the Plan.

Shipping, freight, delivery, removal, reinstallation, packing and handling costs are not covered by the Plan.

If Cubie by Brandstand requires return of a Covered Product, Cubie by Brandstand will provide return instructions, but the customer is responsible for shipping and related costs unless Cubie by Brandstand expressly agrees otherwise in writing or applicable law requires otherwise.

Cubie by Brandstand will not reimburse unauthorized shipping, freight, labor, removal, installation or other incidental expenses.

12. Transferability

The Plan remains associated with the original Cubie by Brandstand order and Covered Products. Subject to applicable law, the remaining Plan coverage may transfer with the Covered Products to a subsequent owner, provided the transferee can provide the original Cubie by Brandstand order or invoice and proof reasonably sufficient to identify the Covered Products.

No transfer fee applies. A transfer does not restart or extend the Coverage Term or increase the Coverage Amount.

13. Cancellation and Refunds

You may request cancellation of the Plan by contacting Cubie by Brandstand Customer Service.

If you cancel within thirty (30) days after Plan purchase and no claim has been made, Cubie by Brandstand will refund 100% of the Plan Price.

After thirty (30) days, any cancellation right, refund amount, cancellation fee, and timing of payment will be determined in accordance with applicable state law and any state-specific provision applicable to you.

If Cubie by Brandstand cancels the Plan, Cubie by Brandstand will provide any notice and refund required by applicable law. Cubie by Brandstand may cancel for nonpayment, fraud, material misrepresentation, or substantial breach of duties relating to the Covered Products or Plan, subject to applicable law.

State law may provide additional or different cancellation and refund rights, which will control if inconsistent with this Section.

14. Limitation of Liability

To the maximum extent permitted by applicable law, the Plan provides service only for the Covered Product itself.

The Plan does not provide coverage for bodily injury, fire, smoke, water or other property damage, loss of use, lost time, lost revenue, lost profits, lost data, or any other incidental, indirect, special, punitive, consequential or collateral loss allegedly arising from a Covered Product or its failure.

Any claim concerning injury or damage allegedly caused by a product is outside the scope of this Protection Plan and is governed by applicable law.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

15. Relationship to Cubie by Brandstand's Standard Warranty and Implied Warranties

The Plan does not replace Cubie by Brandstand's standard product warranty.

During any period in which a failure is covered by Cubie by Brandstand's standard warranty, the standard warranty will apply. The Plan provides covered service through the end of the selected Coverage Term.

Nothing in these Terms is intended to disclaim or limit any implied warranty or other right that applicable law prohibits Cubie by Brandstand from disclaiming or limiting.

16. Entire Agreement; Changes

These Terms, together with the applicable Cubie by Brandstand order or invoice and any state-specific disclosure provided with the Plan, constitute the agreement governing the Plan.

No oral statement changes these Terms. If any provision is prohibited or unenforceable under applicable law, that provision will be applied or modified only to the extent necessary to comply with law, and the remaining provisions will remain in effect.

17. Governing Law and State-Specific Rights

The Plan is subject to applicable federal law and the service contract laws of the state in which the purchaser resides or the Plan is sold, as applicable.

State law may provide additional rights, disclosures, cancellation terms, complaint procedures, financial-security protections or other requirements that supersede inconsistent provisions in these Terms.

Nothing in these Terms waives rights or remedies that cannot be waived under applicable law.

State-Specific Provisions

If a state-specific addendum or disclosure is provided with your Plan, that addendum is incorporated into these Terms and controls to the extent it conflicts with the general Terms above.

Applicable state law may also provide rights that cannot be waived or reduced by contract.
